Employment Equity legislation is compulsory for all Designated Employers – hereโs how to know if you are a Designated Employer.
If you answer YES to any of the following questions, you are a Designated Employer:
- Do you employ 50 or more people?
- Do you employ less than 50 people BUT your total annual turnover exceeds that in the table below for your sector?
- Have you been declared a Designated Employer in terms of a collective agreement?

If you answered yes to any of these questions, you absolutely have to submit for Employment Equity and you need to comply with the legislation or face penalties of at least R1.5 million fines and even imprisonment.
